Terms and conditions
FELIX LUPA is committed to providing quality photographic and/or touristic services to the participants, here in after referred to as beneficiaries, within the photo tours. All services offered are subject to the provisions found below and in the service contract that will be concluded between the provider and the beneficiary.
Acceptance of these conditions is implicitly made by the Beneficiary upon filling out the registration form and paying the 300 euro advance.
Registration of participants:
After completing the form, you will receive an e-mail confirming that you are in our records. I will send you a payment details as soon as possible.

Registration is considered valid only when you pay the deposit established for the respective tour.
Cancellation/rescheduling of participation:
Cancellation of participation in one of our tours can only be done in writing to the address: felixlupa@gmail.com ; the following amounts will be withheld to cover organization expenses:
For external tours:
The registration of the participants in the external tours is done in the same way as above, but the cancellation of the participation is done under different conditions:
* between 90 and 70 days before the start of the photo-tour, the initial deposit for the tour will be retained, to cover common expenses.
* between 69 and 45 days before the start of the photo-tour, an amount of 50% of the total value will be withheld to cover common expenses.
* between 44 and 25 days before the start of the photo-tour, an amount of 75% of the total value will be withheld to cover common expenses.
* less than 25 days before departure or if the participant does not show up for the photo tour, 100% of the total amount will be withheld.
These are general conditions for canceling participation in our tours. For specific cases, the cancellation conditions are presented at each shift.
Payment of external tours
The price of external tours will be Payment by bank transfer made in ILS.
Health conditions:
By completing the registration form and paying the advance/deposit, the participants certify that they do not suffer from mental illnesses or other disabilities that could create a risk for them or the other participants. We reserve the right to ask for a medical certificate proving good health.
Once the registration has been completed, medical circumstances will be considered exceptions to the application of cancellation policies, only if a relevant medical certificate is presented attesting the impossibility to participate. In this case, we reserve the right to return a certain amount of the shipping cost, depending on the cancellation date.
Insurance:
Medical and accident insurance is mandatory for all tour/expedition participants.
Also, I particularly recommend taking out a cancellation insurance immediately after registering for the tour, based on the documents issued by the Agency, to cover a possible withdrawal from the tour for personal/medical reasons.
General terms and conditions:
The rights and obligations of the Agency
1. If the Agency is forced to modify one of the essential provisions of the contract, it has the obligation to inform the tourist at least 15 days before the departure date. The occurrence less than 15 days before departure of situations unforeseen by the Agency and not determined by it, such as: changing the hotel without having a lower category, changing the airline or the flight schedule, determines the Agency's obligation to inform the tourist as soon as he becomes aware of the change. Such situations are not considered to modify the essential provisions of the contract and do not constitute grounds for withdrawal.
2. It can modify the contract price in the sense of increasing or decreasing, as the case may be, only if the modification takes place as a result of variations in transport costs, royalties and taxes related to landing, disembarkation/embarkation services in ports and airports and taxes tourist or of the exchange rates related to the contracted tourist service package.
3. In the event of overbooking of a hotel, determined by the activity of the hoteliers, before or after the start of the trip, the Agency will offer the option of a hotel in the same area or in a nearby area, in the same category or of a higher category, without modifying the price.
4. If, after the start of the tourist trip, an important part of the tourist services provided in the contract is not performed or the organizing travel agency finds that it will not be able to perform them, the Agency is obliged to offer the tourist appropriate alternatives in order to continue the tourist trip , without increasing the price, respectively the tourist services offered must be of the same quality and quantity.
5. The agency is responsible for the proper execution of the obligations assumed by the contract, with the exception of the following cases:
a) when the non-fulfillment or defective fulfillment of the obligations assumed by the contract is due to the tourist;
b) when the non-fulfillment of the obligations is due to force majeure, or circumstances that neither the travel agency nor the service providers could foresee or avoid (timetable or itinerary changes, delays in the means of transport, strikes, causes natural disasters that prevent transport/accommodation, etc.). Thus, within the framework of the organization of Charter races, the Agency is not responsible for damages caused to the tourist as a result of race delays (including charter races), lost luggage, as well as other circumstances for which the air carrier bears sole responsibility.
The rights and obligations of the tourist
1. If the tourist cannot participate in the tourist trip, he can assign the contract to a third party who fulfills all the conditions applicable to the contracted tourist service package, with the obligation to notify the Agency in writing at least 5 days before the date of departure. In this case, the Agency terminates the contract with the tourist who assigns the contract and concludes another contract with the new tourist. The tourist who assigns his package of services, as well as the assignee, are jointly and severally responsible for paying the price of the trip and any additional costs arising on the occasion of this assignment.
2. If the prices established in the contract are increased by more than 15%, the tourist can terminate the contract, having the right to reimbursement by the Agency of the amounts paid.
3. If the tourist terminates the contract on time, without penalties or the Agency cancels the tourist trip before the departure date, the tourist has the right:
a) to accept at the same price another package of tourist services of equivalent or superior quality, proposed by the Agency;
b) to accept a package of tourist services of lower quality, proposed by the Agency, with immediate reimbursement of the price difference;
c) to be immediately reimbursed all the sums paid under the contract, if there are no penalties (with the exception of cases of force majeure, in which the Agency is exempt from liability and has no obligation to reimburse the value of the trips).
3.1. In all the cases mentioned, the tourist has the right to ask the Agency for compensation for non-fulfillment of the provisions of the initial contract, with the exception of the cases in which:
a) the cancellation was made due to the failure to meet the minimum number of people mentioned in the contract, and the Agency informed the tourist in writing at least 15 calendar days before the departure date;
b) the cancellation was due to a case of force majeure (unforeseeable circumstances, independent of the will of the person invoking them and whose consequences could not be avoided despite any efforts made, this not including overbookings);
c) the cancellation was due to the fault of the tourist.
4. The tourist has the right to terminate the contract at any time, in whole or in part, and if the termination is imputable to him, he is obliged to compensate the Agency for the damage caused to it, including in the event of the tourist becoming ill, events his family or other such situations that are not assimilated to force majeure. If the tourist requests to change the hotel, the structure of the rooms or any of the services, this is equivalent to the termination of the contract, with the application of legal penalties at that time and the conclusion of a new contract.
5. The tourist is obliged to pay at the reception of the hotel unit the resort tax, sanitation tax, as well as other local taxes, without being able to claim compensation or return the amounts from the Agency.
6. If in order to carry out the trip it is necessary for the tourist to fulfill some additional formalities (e.g. traveling with minors, the situation in which the tourist's name is changed as a result of her marriage/dissolution, etc.), he will fulfill all the legal requirements.
7. If a single person hires services for a larger number of tourists, the terms of the contract automatically extend to the entire group for which the services were paid.
Penalties, compensations
1. If an embassy refuses to grant an entry visa for the performance of the service package, the tourist will be withheld all fees paid by the Agency to direct providers, as well as the agency's commission.
2. If the tourist who entered the territory of the state where the package of tourist services is carried out refuses to return to his country and the authorities of the respective country make expenses of any kind with him, the respective tourist has the obligation to bear all these costs.
3. Penalties equivalent to the contract price also apply if the tourist does not arrive on time at the airport or the place of departure, if he cannot leave for the trip because he does not have the correct documents or if he is turned away from the border by the police of the border.
4. The tourist must submit in writing the request to cancel the package of tourist services, with the registration number to the Agency where he paid for the services. Otherwise, the cancellation request is not taken into account.
